The current fixed-fee scope, exclusions, third-party costs, client responsibilities and other service terms.
Our Fixed Fee Eviction Service is provided for a fee of £1,500 plus VAT per property and covers the standard legal eviction process from the service of the relevant notice through to obtaining possession by way of County Court bailiffs.
1. Service Overview
Our Fixed Fee Eviction Service is provided for a fee of £1,500 plus VAT per property and covers the standard legal eviction process from the service of the relevant notice through to obtaining possession by way of County Court Bailiffs.
The service includes:
- Review of the matter prior to commencement.
- Preparation and service of the appropriate statutory notice (where instructed).
- Preparation and submission of the possession claim.
- Management of the possession proceedings.
- Attendance at one possession hearing, where required.
- Application for a County Court Bailiff warrant (where applicable).
- Management of the matter until the County Court Bailiff attends to recover possession.
2. Court Hearing Attendance
The fixed fee includes attendance at one court hearing only.
If the court adjourns the proceedings, lists a review hearing, directions hearing, reconsideration hearing, or any further hearing for any reason, attendance at each additional hearing will be charged separately at our prevailing hourly rate or fixed fee applicable at the time.
Additional hearings may become necessary for reasons including (but not limited to):
- Court adjournments.
- Tenant applications.
- Judicial directions.
- Errors or omissions in documentation supplied by the client.
- Any other matter outside our reasonable control.
Payment for any additional hearing must be made before attendance unless otherwise agreed in writing.
3. Bailiff Attendance
Our service includes arranging and managing the County Court Bailiff appointment.
Unless expressly agreed in writing:
- We do not attend the Bailiff appointment.
- We do not provide locksmith services.
- The cost of changing locks is not included within the fixed fee.
It is the client's responsibility to arrange for a locksmith to attend the Bailiff appointment if vacant possession is obtained.
4. Client Responsibilities
The client agrees to:
- Provide accurate and complete information.
- Supply all documentation requested promptly.
- Ensure any tenancy documentation provided is accurate and complete.
- Notify us immediately of any communication received from the tenant or the court.
- Cooperate throughout the eviction process.
We shall not be responsible for delays or additional costs arising from inaccurate, incomplete or late information provided by the client.
5. Matters Outside the Fixed Fee
Unless expressly stated otherwise, the fixed fee does not include:
- Additional court hearings.
- Appeals or applications by either party.
- Applications to suspend or set aside possession orders.
- High Court Enforcement Officer transfers or enforcement.
- Enforcement against trespassers or unlawful occupiers.
- Debt recovery or enforcement of rent arrears.
- Claims for damages.
- Locksmith attendance or lock replacement.
- Property clearance or storage of tenant belongings.
- Attendance at the property other than where expressly agreed.
- Any expert reports or third-party professional fees.
Any additional work requested by the client will be charged separately.
6. Court Fees and Third-Party Costs
Unless specifically stated in our quotation or engagement letter, court fees, process server fees, tracing fees, enforcement fees and any other third-party disbursements are payable by the client in addition to our fixed fee.
Where we pay disbursements on the client's behalf, these must be reimbursed upon request.
7. Timescales
Eviction timescales are determined by the courts, government agencies and enforcement officers and are outside our control.
We do not guarantee possession by any specific date.
8. No Guarantee of Outcome
Whilst we will use reasonable skill and care in conducting the matter, we cannot guarantee:
- That possession will be granted.
- The timeframe in which possession will be obtained.
- That enforcement will proceed without delay.
- Recovery of rent arrears or legal costs.
Court decisions remain entirely at the discretion of the judiciary.
9. Cancellation
Where instructions are cancelled after work has commenced, we reserve the right to charge for work completed and any disbursements incurred up to the date of cancellation.
Any non-refundable court fees or third-party costs already incurred remain payable.
10. Changes in Law
Should legislation, court procedure or government guidance materially change after instruction, we reserve the right to amend our fees where additional work becomes necessary. Any such changes will be discussed with the client before additional work is undertaken.
11. Acceptance
By instructing us, the client confirms that they have read, understood and accepted these Terms & Conditions and agrees to be bound by them.
