Case preparation

What to gather before referring a possession case.

A clean first submission helps BTC understand the route, identify gaps and reduce avoidable back-and-forth.

Core case information

Start with the tenancy and the reason for possession.

  • Tenancy agreement and current tenancy details
  • Deposit information and relevant prescribed-information records
  • Proof of property ownership / right to possession
  • Applicable property licence where the property is licensable
  • Landlord's reason for seeking possession
  • Evidence supporting that reason
  • Relevant tenant correspondence
  • Any notices, court papers or enforcement documents already issued

Ground-specific evidence

Not every case requires the same evidence. Examples may include:

  • Detailed rent schedule for arrears cases
  • Evidence of intention to sell where sale is relied upon
  • Evidence of intended occupation where applicable
  • Records of breaches, complaints or property-condition issues where relevant

BTC should review the facts of the individual case before the correct route is confirmed.
